1. PARTIES
Hereinafter, the relevant travel agency shall be referred to as the “AGENCY”, and the person wishing to purchase the programs and services offered for sale by the AGENCY shall be referred to as the “CONSUMER”.

2. SUBJECT
This Agreement covers the services specified in the Tour Registration Form, Voucher (Package Tour Agreement), Tour Program/Brochure, and Receipt Document, all of which constitute an annex and an integral part of this Agreement.

3. GENERAL PROVISIONS
The CONSUMER acknowledges, declares, and undertakes that they have read and are informed of the brochure containing detailed information regarding the nature of the service subject to this Agreement, the sales price, payment method, and execution details; that for international accommodations, they will carry a passport valid for at least six months from the tour departure date with at least two blank pages for entry/exit stamps, a valid visa, and national ID card where applicable; and that for Cyprus tours a national ID card is sufficient.
The CONSUMER accepts that the AGENCY bears no legal and/or criminal responsibility in case the CONSUMER’s departure is prevented due to deficiencies in passport procedures or due to personal reasons arising from the CONSUMER (such as tax debts, missing visa, or refusal by any governmental authority), or if entry to the destination country is denied due to passport, visa, or similar procedural deficiencies or non-compliance; that the CONSUMER is solely responsible for all matters related to their baggage; and that the AGENCY and its employees bear no legal and/or criminal liability for lost, stolen, or damaged items during the tour. The CONSUMER shall not make any claim against the AGENCY or its employees for such reasons.
By signing this Agreement, the CONSUMER agrees to comply with the rules of the accommodation facility and the transportation vehicles to be used, as well as any rules communicated by guides, facility representatives, the agency, and transportation officials. The CONSUMER accepts full personal and primary responsibility for any material or moral damages caused by endangering the safety or integrity of third parties, and acknowledges that the AGENCY may cease to provide services under this Agreement in such cases, with no refund right to the CONSUMER.
The CONSUMER agrees to pay for all additional food and beverage, personal expenses, and services not included in the package tour price. If the CONSUMER terminates the service on the grounds that it is defective, they must notify the AGENCY representative and the hotel in writing, otherwise the service shall be deemed to have been received and utilized.
The CONSUMER acknowledges that they are also a party to the Agreement on behalf of accompanying participants, that they must provide accurate information (names, ID numbers, etc.) of all accompanying persons, and that they are responsible for informing them regarding the preliminary information and brochure content. The brochure given to the CONSUMER is deemed delivered to all participants.
Except in cases arising from the CONSUMER’s fault, unforeseeable or unavoidable acts of third parties, force majeure (adverse weather conditions, road closures, strikes, terrorism, fog, war risk, unforeseeable technical issues, etc.), or events that occur despite the AGENCY taking all necessary measures—none of which give rise to compensation rights—the AGENCY shall be liable for damages suffered by the CONSUMER in cases of partial or complete breach of the Agreement, subject to the mandatory insurance provisions defined under Law No. 1618.
In package tours involving air transportation, in cases of baggage loss or damage caused by gross negligence of the AGENCY, compensation shall be handled in accordance with the Montreal Convention, provided that the CONSUMER obtains an official loss or damage report. If the CONSUMER is a minor, the absence of a legal guardian may result in inability to receive services; in such cases, cancellation terms shall apply.

4. SERVICE FEE AND RIGHT OF WITHDRAWAL
All services specified in the Reservation Document (“Voucher”) are included in the Agreement price. Any services not included are subject to additional charges.
For international package tours, 100% of the service fee must be paid at the time of booking. For early bookings, full payment must be completed by the campaign end date.
If, after execution of the service, the bank or financial institution refuses to transfer the service fee to the AGENCY due to unauthorized or fraudulent use of the CONSUMER’s credit card through no fault of the AGENCY, the CONSUMER shall be liable for the disputed amount and all resulting damages, including legal interest starting from the reservation date.
In cases of extraordinary changes in exchange rates, fuel costs, or legal obligations such as taxes, fees, or charges collected at ports or airports, the price may be increased by notifying the CONSUMER at least 20 days prior to departure. The CONSUMER agrees to pay the difference or forfeits the right to participate in the service.
Refunds shall be made using the original method of payment (in the same currency or to the same credit card used).
If the CONSUMER fails to provide written notice that they will join the service after missing the start time, the AGENCY reserves the right to cancel all reservations and no refund shall be made.

5. TERMINATION AND TRANSFER
If the AGENCY unlawfully terminates the Agreement, it shall refund all payments made by the CONSUMER within 14 days.
If the minimum number of participants required for the tour is not reached, the AGENCY shall inform the CONSUMER at least 20 days before departure. The CONSUMER shall not be entitled to any compensation in such cases.
If the CONSUMER terminates the Agreement at least 30 days before the start of the service, the full amount paid shall be refunded, excluding non-refundable taxes, fees, and similar mandatory charges.
If terminated within 30 days but more than 15 days before departure, 50% of the amount paid shall be refunded (excluding mandatory charges). Date change requests are considered termination.
If terminated within 15 days before departure, no refund shall be made.
Exceptions apply if the CONSUMER or their first-degree relative presents written proof of death or medical conditions preventing participation. Refunds shall then be made within 14 days, excluding mandatory fees and unrecoverable third-party charges.
The CONSUMER may transfer the service to another person who meets package tour requirements by notifying the AGENCY in writing at least 15 days before departure. The transferee and transferor are jointly responsible for all arising costs.
If the CONSUMER does not notify participation within 24 hours after missing the service start, the AGENCY may cancel all services without refund. If notice is given within 24 hours, price differences for transportation services shall be paid by the CONSUMER.
The AGENCY may cancel or modify tours before the service begins by notifying the CONSUMER. If the CONSUMER does not accept such changes, they may choose one of the following within 48 hours:
1. Withdraw from the Agreement and receive a refund within 14 days,
2. Join another package tour of equal or higher value without extra payment,
3. Choose a lower-priced tour and receive the price difference as a refund.

FORCE MAJEURE
The AGENCY shall not be held liable for any direct or indirect damages resulting from unforeseeable or unavoidable circumstances beyond its control, including but not limited to natural disasters (earthquake, flood, fire, landslide, volcanic eruption), extraordinary events (curfews, terrorism, wars, riots, military interventions), public movements (strikes, demonstrations, road blockages), diplomatic restrictions, health-related issues (epidemics, quarantines), adverse weather (snow, storm, fog, lightning), customs regulation changes, general transportation restrictions, bankruptcy or liquidation of transportation companies, etc.
In such cases, the AGENCY may terminate the Agreement and cancel the tour unilaterally. The AGENCY is also not responsible for delays, breakdowns, accidents, or driver-related issues regarding transportation vehicles (buses, minibuses, rental cars, trains, ferries, aircraft, helicopters, balloons).
The CONSUMER accepts and undertakes that no material or moral claims shall be made against the AGENCY in such circumstances.

PROTECTION OF PERSONAL DATA
This clause includes provisions regarding the processing of personal data under the Law No. 6698 on the Protection of Personal Data. The AGENCY, as the Data Controller, processes personal data on behalf of and upon authorization of the CONSUMER, and is responsible for determining the purposes and means of data processing and managing the data recording system.

6. MISCELLANEOUS PROVISIONS
In package tours, cases of incomplete or non-provision of services are covered by mandatory insurance under Article 12 of Law No. 1618. The CONSUMER may additionally insure themselves for medical expenses, accidents, and repatriation before the service begins.
If flight tickets are purchased as round-trip under the same PNR, failure to use the outbound flight results in automatic cancellation of the return flight per airline rules.
Invalidity of any clause does not affect the remaining provisions.
The CONSUMER is responsible for notifying the AGENCY of any change in their contact details; otherwise, notifications sent to the provided addresses shall be deemed valid.
Disputes arising from this Agreement shall be governed by Turkish Law, and Istanbul Anatolian Courts and Enforcement Offices shall have jurisdiction.
This Agreement, consisting of five (5) pages and six (6) articles, has been mutually negotiated and signed in a single copy, with a true copy delivered to the CONSUMER.
For matters not specified herein, the provisions of Law No. 1618, relevant regulations, directives, circulars, Law No. 2634, and IATA, IHA, UFTAA Convention Rules shall apply.
By signing this Agreement, the CONSUMER acknowledges that they have received, reviewed, and understood the brochure and/or website information related to the purchased service, the Tour Registration Form, Voucher (Package Tour Agreement), and the Service Reservation/Sales Agreement.

COMMERCIAL ELECTRONIC MESSAGE CONSENT
The CONSUMER hereby consents to receiving commercial electronic communications (SMS, email, etc.) regarding services, advertisements, promotions, announcements, and activities related to the brands operated by the AGENCY and its business partners, in accordance with Law No. 6563. The CONSUMER may revoke this consent at any time by notifying the AGENCY through the communication channels stated in this Agreement.
